Hello All,
My intention in this post is to inform those on the board about a transaction gone bad.
I responded to a post by Armorstuv about kits for sale on 01-10-08 (not sure of the original post date). I contacted him about 3 of those kits (Tamiya Tiger I, Panther and J.S.-3) and agreed to send $68.00 for the 3 kits ($58.00) and shipping ($10.00).
I sent the $68.00 out on 01-11-08 (payment by U.S.P.S. money order) to
Stuart Vandervort

Madison, Wisconsin

I do not remember the day I received a "receipt of payment" pm from Stuart, but receipt of payment was verified by Stuart.
I attempted to contact Stuart via both pm and e-mail prior to 01-28-08, possibly between the 23rd and 26th.
Since I received no reply, I posted (01-28-08) on the board asking if anyone had any information about Stuart. Within 6 hours of the post I received a pm from Stuart. He stated in that pm that he "apologized" for not sending the kits and that the delay was "inexcusable". He also assured me that he was "heading to the post office in the a.m." to send out the kits.
The mailing date would have been Tuesday 01-29-08. After not receiving the kits by 02-02-08 (coming from Wisconsin to Ohio) I sent an e-mail to Stuart on 02-03-08 asking for verification of shipment and by what class. I have not received a reply.
I have heard from two others who have contacted me about not receiving items they have paid for, so mine, unfortunately is not an isolated case.

Well, hopefully Stuart will reply with some good news for you. I also had a transaction in the works, the outcome of which will be determined by how he handles the situation with you, sadly.

Perhaps you can contact Stuart and ask him why this happened. He hasn't replied to my request for information.
Maybe Stuart will come on the board and have some good news for the 3 people that are waiting on him to complete the transaction.

I'm one of the "others" that have paid, but have not received the kit I bought, nor heard from Stuart.

On 29 December 2007, I send Stuart a PM requesting to know what kit number the Dragon JagdTiger was and to confirm that the kit was $20 plus shipping. On the 01 January 2008 he responded indicating that the kit was indeed $20 and shipping would be around $7....but no kit number...right after that PM I again asked the kit number and on 04 January 2008 he informed me that it was #6051. That same day I confirmed that I would indeed purchase the kit. Shortly afterwards, he sent me his mailing address (which, I just noticed does differ from what Joe listed (simple mis-type I'm sure as Joe's payment was confirmed as received as was mine):

On 07 January 2008, I informed Stuart that the money order was mailed and on 9 January 2008 he confirmed receipt of the money order and stated he would ship it "either today or for sure by Thursday" (9th or 10th of January 2008).

On 14 January 2008 I received my last contact from Stuart regarding this auction. He stated: "Sorry for the delay." He indicated that there was a health issue with a family member and that: "It will be going out tommorrow for sure."

My last PM I sent him was on 29 January 2008: "Just a quick FYI....The JagdTiggy hasn't shown yet." He has in fact opened that PM. He has in fact NOT responded to it.

Well, it's now the 5th of February and his last contact to me was on the 14th of January...23 days later and the kit has not arrived. 23 days later and I have not heard anything else.

So, in light of this posting by Joe, I am concerned. I'm out $27 which is considerably less than Joe, but $27 is indeed $27.

I would be very happy with either receiving the kit I bought, or a refund of the $27 I sent. It's still my hope that this "issue" resolves itself.

Well...add me to the list.
Sent a Money Order on January 14th. Didn't hear a thing until the PM he sent on the Jan. 28 saying he will send the kit out on the 29th.
Still no kit and still no word on the status...

I'm out $27 as well. Treat others as you would want to be treated. That's all I ask.

I feel for you guys. Although I have had great luck with internet transactions, with only 1 bad transaction out a couple of hundred. That one experience really left me with a bad taste in my mouth, and it took me a while to jump back in the water so to speak.

This is our only defense with these kind of individuals, Word Of Mouth. Although I hope that Stuart comes through in the end, I do thank you guys for standing up and letting the rest of us know.

Thanks for the correction on the address.
As far as kits or a refund, my preference is a refund. This has dragged on way too long. It can be for $69.45 by U.S.P.S. money order.
That would be $68.00 (original payment), $1.05 (cost of the money order) and $0.41 (postage).

Seems to me that you guys have a good case for a Federal Fraud Charge.
Stuart used mass communication devices to defraud you guys across state lines. Now it seems to me Stuart (or whatever his name is) ought to "Pony" up with the kits or refunds or you guys all contact your local FBI office and file a report of mail fraud!
Just a thought.

It would have to go to the Post office as mail fraud. However I think there might be a minimum amount that was lost before a case can be filed. I hope I am wrong about this. It is such a pain to get burnt like this. Since I was brunt on Ebay by a byuer, I have not sold a thing on there.

Well, it's this way for me. He doesn't need to ship the kits, as a matter of fact, I don't want the kits. He had plenty of chances to do right. He no longer deserves to make the sale, in my opinion. All he needs to do is send $69.45 to me. He can just put the cash (I don't want to add any additional burdens on him, by requesting a money order) in an envelpope, do a delivery confirmation (notify me as to the confirmation number) and send it on it's way. Being that he's destroyed any confidence I might have had in him, a check is simply out of the question. No need for correct change. Just send $70.00 and I'll make sure he gets his $0.55 change.
I'll make it even easier, I'll take Pay-Pal.
Wonder why he hasn't notified the buyers about this trouble?
He is in control of the situation. The burden is on him to do the right thing.
I trusted him and all I have to show for it (at this point) is a $68.00 hole in my wallet.
Step up Stuart and do the right thing.

You are not going to believe this, I almost bought the 6051 jagdtiger and the Tiger I from this guy. Problem is, I was talking the deal with him weeks after you both paid for the kits. Makes you wonder how many others he has done this to. Maybe thats why you don't have your kits.

Seems this information eliminates any other possibilities regardless of how slim they may have been. Obviously not personal/family problems, difficulty in getting the kits shipped or any other excuse/reason that was given.
Possibly the only question remaining is whether he will decide to remain a thief or decide to change and start doing what is right.

Well guys, here's a kicker.....JagdTiggy showed today....Dragon 6051.....odd, no return addy, but it's here and sealed.

I did receive a PM from Stuart the day before yesterday indicating it was shipped (Feb. 5)....and it's here, quicker than I was expecting based on the PM.

So, this part is complete. I'm sure other things will work out.
